Hey folks! I guess you can tell by the title what this is all about. As a former FFL dealer I get a little anxious about private sales. I hate asking folks to do any paperwork not being an FFL anymore. After all FFL's are legal and required to obtain and store personal info. I just feel like a bill of sale with a DL# or a CHCL# is just a good idea. i currently do not take any info. I also look at it from a personal perspective, i wouldn't just give personal info to a complete stranger nor would i advise anyone else to. I love the whole private sale concept. I personally feel as though we shouldn't have to ask to purchase any kind of arms. Our founders were right about our God given rights. After all, that's partly why I didn't renew my FFL, and I was doing better financially with other interests. Still, kind of conflicted. What are your thoughts?
Honestly, I think there is a middle ground.
I usually ask ahead of time whether they would be comfortable signing a simple bill of sale. When we meet, I also ask to see a driver’s license just to confirm who I am dealing with. To me, someone being upfront and willing to verify their identity is a good sign.
That said, I understand not wanting to hand over all of your personal information to a complete stranger. If everything checks out, the person seems normal, and they were willing to show ID, I am usually comfortable deciding together whether we actually need to put all of that information on paper or whether a handshake is enough.
For me, it is less about creating unnecessary paperwork and more about making sure I am comfortable with the person and have no reason to believe there is an issue. If anything feels off, I would rather walk away or use an FFL transfer than force a sale.
I agree with you though — private sales should stay private. I just try to use a little common sense to protect myself without making every transaction feel like an FFL transaction.
@kwiver Very well stated. When I was selling under an FFL the topic never came up because it was simply a requirement to completing the sale. As you said, just having the conversation with a prospective buyer goes a long way. I think your response will help myself and others going forward. Thanks!
