Since I posted on a person under 21 trying to purchase a handgun from me I had multiple conversations with lawyers and law enforcement at several different levels. The consensus is, in Arkansas a person must be 21 to purchase a handgun or handgun ammo from a licensed dealer. However, there is no provision in the law prohibiting the private sale or gifting of a handgun or ammo to persons under 21. That being said, if the person is 18 years of age or older the private sale can legally take place providing the person is 18 YOA or older. However much of a technicality it is or what could be construed as a "loophole" in the law there is an absence of instruction in this matter. I guess it's like most things, it simply boils down to a judgenent call. Honestly, if an 18YO can purchase an AR,MSR or tactical shotgun a handgun isn't going to make that big of a difference. I guess we all have decisions to make. Tell me what you think. Thanks!

I have a G27 for sale and an under age person scheduled to meet to buy. To their credit they admitted their age via text prior to meet. This person's phone number is (479) 208-0136 or (479) 275-8570 they said they were from Fort Smith, Arkansas.I don't know if they are male or female. I do know they are convinced they can purchase a handgun and ammo at 18 years of age through a private sale they even cited Arkansas law. I informed them that the state of Arkansas is very clear on this law. NO ONE under 21 years of age can purchase or possess a handgun or handgun ammunition unless said ammunition is used in a long gun in their possession at the time. It doesn't matter if we agree with it or not, that's the law. According to this young person they have attempted to purchase on here prior to this attempt and got denied by the seller. I held the gun as "pending" for two days and just hours before the meet they told me their age and admitted they had been turned down before and didn't want to make the drive if age was an issue. Just a friendly piece of advice, make sure you indicate 21 and over on your handgun ads. I know it's on them to follow the law but that won't satisfy the law when they track it back to you.

I usually ask ahead of time whether they would be comfortable signing a simple bill of sale. When we meet, I also ask to see a driver’s license just to confirm who I am dealing with. To me, someone being upfront and willing to verify their identity is a good sign.

That said, I understand not wanting to hand over all of your personal information to a complete stranger. If everything checks out, the person seems normal, and they were willing to show ID, I am usually comfortable deciding together whether we actually need to put all of that information on paper or whether a handshake is enough.

For me, it is less about creating unnecessary paperwork and more about making sure I am comfortable with the person and have no reason to believe there is an issue. If anything feels off, I would rather walk away or use an FFL transfer than force a sale.

I agree with you though — private sales should stay private. I just try to use a little common sense to protect myself without making every transaction feel like an FFL transaction.

Hey folks! I guess you can tell by the title what this is all about. As a former FFL dealer I get a little anxious about private sales. I hate asking folks to do any paperwork not being an FFL anymore. After all FFL's are legal and required to obtain and store personal info. I just feel like a bill of sale with a DL# or a CHCL# is just a good idea. i currently do not take any info. I also look at it from a personal perspective, i wouldn't just give personal info to a complete stranger nor would i advise anyone else to. I love the whole private sale concept. I personally feel as though we shouldn't have to ask to purchase any kind of arms. Our founders were right about our God given rights. After all, that's partly why I didn't renew my FFL, and I was doing better financially with other interests. Still, kind of conflicted. What are your thoughts?
